TRANSMITTAL LETTER FOR BOARD MEETING OF MAY 6, 2010

COMMITTEE ON PROCUREMENT

Mr. Richard Lanyon, Executive Director

Title

Authority to decrease Contract 07-163-3M (Re-Bid) R & D Building HVAC Improvements, Stickney Water Reclamation Plant, to Path-Milhouse, Joint Venture, in an amount of $7,502.55, from an amount of $8,267,554.29, to an amount not to exceed $8,260,051.74, Accounts 401-50000-645680 and 645780, Purchase Order 5001056

Body

Dear Sir:

On July 9, 2009, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 07-163-3M (Re-Bid) R & D Building HVAC Improvements, Stickney Water Reclamation Plant, to Path-Milhouse, Joint Venture, in an amount not to exceed $8,253,300.00. The scheduled contract completion date is April 24, 2011.

As of April 16, 2010, the attached list of change orders has been approved. The effect of the sole change order resulted in an increase in the amount of $14,254.29 from the original amount awarded of $8,253,300.00. The current contract value is $8,267,554.29. The prior approved change order reflects a 0.17% increase to the original contract value.

The contract includes the installation of new cooling towers. After review of the Cooling Tower Piping Plan and performing field measurements, the engineer determined that the specified cooling towers are too large for the installation location. The engineer requested that the contractor supply cooling towers, which are dimensionally smaller than the specified model.

The contractor submitted a price proposal (COR-2) for an extra in the amount of $201,497.73, and a credit in the amount of $209,000.28, for a net credit in the amount of $7,502.55. The engineer reviewed the proposal, found it reasonable, and stated via correspondence 266, that the Engineering Department would recommend its approval.

This change order is in compliance with the Illinois Criminal Code since the change is germane to the contract.

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to decrease Contract 07-163-3M (Re-Bid) in an amount of $7,502.55 (0.09% of the current contract value) from an amount of $8,267,554.29, to an amount not to exceed $8,260,051.74.

Funds will be restored in Accounts 401-50000-645680 and 645780.

Requested, Kenneth A. Kits, Acting Director of Engineering, TEK:JAW

Recommended, Darlene A. LoCascio, Director of Procurement and Materials Management

Respectfully Submitted, Barbara J. McGowan, Chairman Committee on Procurement
