TRANSMITTAL LETTER FOR BOARD MEETING OF MAY 20, 2010

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Scott Dickinson vs. MWRDGC, Claim No. 0200004570, Illinois Workers’ Compensation Commission, in the sum of $35,316.67, Account 901-30000-601090

Body

Dear Sir:

Scott Dickinson is a Police Officer at the Calumet Water Reclamation Plant.  On August 17, 2009, while entering the East Gatehouse at Calumet, he tripped and while trying to break his fall, hyperextended his left arm injuring his left elbow and bicep.  He saw his personal orthopedic surgeon, Dr. Joy, at Southside Orthopedics, and was diagnosed with a distal rupture of the bicep tendon, and surgical repair was recommended.  An independent medical evaluation agreed with this diagnosis and treatment plan.  Mr. Dickinson had bicep tendon repair surgery on September 2, 2009.  Home exercise did not improve his strength, and he began formal physical therapy on November16, 2009.  He returned to work on January 8, 2010.  He lost 101 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim can be settled for the sum of $35,316.67 which represents 23% loss of use of the right arm.

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:JLO:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
