Authorize the Village of Worth to conduct its Annual Community Festival from August 6-8, 2010, on its leasehold property located at 115th Street and Oketo Avenue in Worth, Illinois, Cal-Sag Channel Atlas Parcel 8.06

Dear Sir:

 

The Law Department has received a request from the Village of Worth (“Village”) to conduct its Annual Community Festival from August 6-8, 2010, on land leased from the District at 115th Street and Oketo Avenue along the north bank of the Cal-Sag Channel also known as Cal-Sag Channel Atlas Parcel 8.06 in Worth, Illinois.  The Village leases approximately 214.10 acres of District land at that location under a 39 year lease that commenced June 1, 1996, and expires on May 31, 2035.  The Village uses the land for a golf course, driving range, parking lot, and other recreational facilities.

 

The Village has requested permission to conduct its Annual Community Festival (“Worth Days”) on the subject leasehold which will include activities such as carnival rides, concession stands, fireworks display, and a beer garden.  The sale of alcohol on District-owned land leased for a term of at least 20-years is permitted under Illinois Statute 235 ILCS 5/6-15 subject to approval of the District’s Board of Commissioners and the procurement of dram shop insurance.  The subject property falls within those requirements and prior approvals of Worth Days, including the sale of alcoholic beverages, have been granted by the District since 2004.

 

The District’s technical departments have no objections to the Village’s request.  The Village will be required to add the District, its Commissioners, officers, agents, and employees as additional insureds to its $2,000,000.00 dram shop coverage.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the Village to conduct Worth Days from August 6-8, 2010, on the leasehold property located at 115th Street and Oketo Avenue in Worth, Illinois, known as Cal-Sag Channel Atlas Parcel 8.06, subject to the terms set forth herein.
