TRANSMITTAL LETTER FOR BOARD MEETING OF JUNE 3, 2010

COMMITTEE ON PROCUREMENT

Mr. Richard Lanyon, Executive Director

Title

Authority to increase Contract 07-163-3M (Re-Bid) R & D Building HVAC Improvements, Stickney Water Reclamation Plant, to Path-Milhouse, Joint Venture, in an amount of $12,865.07, from an amount of $8,266,147.37, to an amount not to exceed $8,279,012.44, Accounts 401-50000-645680 and 645780, Purchase Order 5001056

Body

Dear Sir:

On July 9, 2009, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 07-163-3M (Re-Bid) R & D Building HVAC Improvements, Stickney Water Reclamation Plant, to Path-Milhouse, Joint Venture, in an amount not to exceed $8,253,300.00. The scheduled contract completion date is April 24, 2011.

As of May 21, 2010, the attached list of change orders has been approved. The effect of these change orders resulted in an increase in the amount of $12,847.37 from the original amount awarded of $8,253,300.00. The current contract value is $8,266,147.37. The prior approved change orders reflect a 0.16% increase to the original contract value.

The contract includes HVAC improvement work at the Monitoring and Research Building laboratory. The engineer determined that the installation of two corrosion resistant valves and two fume hood bypass restrictors is necessary in Room IW-212. The corrosion resistant valves are required since the two fume hoods they serve will be used for highly corrosive chemicals. The original valves were installed under a previous contract (00-473-1D). The bypass restrictors are required to convert the fume hoods from constant air volume hoods to variable air volume hoods, to reduce energy usage by the fume hoods and utilize the existing variable air volume control system.

The contractor submitted a price proposal (COR-11) for an extra in the amount of $12,865.07. The engineer reviewed the proposal, found it reasonable, and stated via Correspondence 324, that the Engineering Department would recommend its approval.

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonable foreseeable at the time the contract was signed, and is in the best interest of the District.

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 07-163-3M (Re-Bid) in an amount of $12,865.07 (0.16% of the current contract value) from an amount of $8,266,147.37, to an amount not to exceed $8,279,012.44.

Funds are available in Accounts 401-50000-645680 and 645780.

Requested, Kenneth A. Kits, Director of Engineering, TEK:JAW

Recommended, Darlene A. LoCascio, Director of Procurement and Materials Management

Respectfully Submitted, Barbara J. McGowan, Chairman Committee on Procurement
