TRANSMITTAL LETTER FOR BOARD MEETING OF JUNE 17, 2010

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Thomas Hickey vs. MWRDGC, Case No. 09 WC 032269, Illinois Workers’ Compensation Commission, in the sum of $33,090.90, Account 901-30000-601090

Body

Dear Sir:

Thomas Hickey is an Operating Engineer I at the Egan Water Reclamation Plant.  On October 11, 2006, while hosing down a floor in the thickener building, he slipped and fell onto a concrete step.  He went to Alexian Bros. Medical Center and complained of chest and left knee pain.  He was diagnosed with two rib fractures and a left knee strain.  The rib fractures healed, but he experienced continued left knee pain.  An MRI later revealed a medial meniscal tear.  On January 2, 2007, he underwent arthroscopic surgery on the left knee to repair the tear.

Mr. Hickey completed a physical therapy program and returned to regular duties on March 26, 2007.  He lost 117 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim can be settled for the sum of $33,090.90 which represents a 1% loss of the person as a whole for the rib fractures ($3,099.85) and 22½% loss of the left leg ($29,991.05).

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
