Dear Sir:

 

The U. S. Geological Survey Office (“USGS”) has requested a 30-day permit to access District property for hydrogeology studies between the DesPlaines River and the Chicago Sanitary and Ship Canal (“CSSC”) in Will County and Cook County, Illinois.  The studies will cover specific areas between Romeoville Road and Willow Springs, Illinois, and involve an investigation to determine if the eggs or fry of Asian Carp can bypass the electric fish barrier by migrating from the DesPlaines River to the CSSC by moving through the fractures in the bedrock between these waterbodies.

 

USGS states that the surveys involve setting up a series of geophones about 3-inches into the soil, then an electronic signal is emitted from a source, the geophones read the signals, and the test is ended.  The geophones are then pulled up and the test continues in another area leaving tent-peg type holes in the ground.  USGS has requested access to the subject areas to commence on June 14, 2010.

The District’s technical departments have reviewed the request, and have no objections to the conduct of the studies in those areas. The permit shall be subject to any terms and conditions recommended by the technical departments.

 

It is recommended that the permit be issued for a nominal fee of $10.00 and that the request for a waiver of the indemnification provision be granted as is customary for District agreements with units of the Federal or State government.  The USGS has been advised, and any grant to it will expressly provide, that the District’s grant is conditioned upon the USGS also obtaining the consent of any District lessee, permittee, grantee, or other party having a legal interest or right to use any of the involved land.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 30-day permit to U. S. Geological Survey Office to conduct hydro-geological studies in conjunction with migration of Asian Carp through bedrock on District land located between the Des Plaines River and the Chicago Sanitary and Ship Canal in Cook County, Illinois; commonly known as Main Channel Atlas Parcels 20.01, 20.09, 21.01, 21.03, 21.04, 21.08, 22.07, 23.01, 23.09, 24.04, 24.08, 24.09, 26.06, and 27.02.  Consideration shall be a nominal fee of $10.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said permit agreement after it is approved by the General Counsel as to form and legality.
