Authority to issue a 1-year permit to Chevron Environmental Management Company for the use of approximately 5.25 acre portion of District real estate located east of the Main Channel in unincorporated Will County, Illinois, and known as Main Channel Atlas Parcel 15.07.   Consideration shall be $28,750.00

Dear Sir:

 

Chevron Environmental Management Company, f/k/a Texaco Refining & Marketing, Inc. (“Chevron”) has requested a permit on a 5.25 acre portion of Main Channel Parcel 15.07 to perform sediment removal work in Deep Run Creek.  Chevron previously leased Parcels 16.01 and 16.02 under two 50-year leases that expired simultaneously on September 30, 2000.  Parcels 16.05 and the southern section of 16.03 were added to the permit to allow Chevron to monitor and remediate offsite migration.  Parcel 15.07 was added to the permit in September 2009 to dredge that portion of Deep Run Creek that runs through Parcel 15.07 as certain contamination was entering the creek.  Parcels 16.01 and 16.02 were used as part of Chevron’s former refinery operations on adjacent land owned by Chevron.

 

In April 2010, the District sold 60 acres comprising Parcels 16.01, 16.02, 16.05, and the southernmost portion of 16.03 to the City of Lockport.  Chevron is now requesting to re-enter Parcel 15.07 to resume dredging Deep Run Creek as its prior efforts to remove sediment were not completed.  No dredgings will be stored on District land, nor will the site be used for staging.

 

The technical departments previously reviewed Chevron’s request to dredge that portion of Deep Run Creek that runs through Parcel 15.07 and had no objections thereto.  It is in the District’s best interest to issue this permit as it involves cleaning a waterway that runs through District property.

 

Chevron’s permit fee shall be $28,750.00, which represents 10% of the pro-rata share of the current fair market value rental for the site determined by recent appraisals on the sites sold to Lockport.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the issuance of a 1-year permit to Chevron Environmental Management Company for the use of approximately 5.25 acres of a portion of District real estate located east of the Main Channel in unincorporated Will County, Illinois, and known as Main Channel Atlas Parcel 15.07.  Consideration shall be $28,750.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute the permit agreement on behalf of the District after it has been approved by the General Counsel as to form and legality.
