Dear Sir:

 

Since February 2002, the U. S. Army Corps of Engineers (“Corps”) has had an easement to construct, and operate an Aquatic Dispersal Barrier (“Barrier IIA”) on the Chicago Sanitary & Ship Canal (“CSSC”) north of the 135th Street Bridge.  The Corps has undertaken to construct another Dispersal Barrier (IIB) whose purpose is to provide redundancy and continued dispersal capacity during periods of maintenance and repair of Barrier IIA.  Said Barrier IIB requires additional electrical power for its operation.

 

At the Corps’ request, Commonwealth Edison (“ComEd”) has requested an approximately 80-foot wide by 260-foot long rectangular-shaped easement, south of the 135th Street Bridge, to operate an electrical substation that will provide electrical power to the Barriers and an adjacent 35-foot wide by 1,800-foot long easement for the construction of overhead power lines that will connect to existing Commonwealth Edison lines and extend to the Barriers.

 

The District’s technical departments have reviewed and had no objections to the request, subject to protection of District facilities.  Next year, the Corps intends to consolidate its easements and permits associated with the Barriers.  Consequently, the easements were granted to end simultaneously with the majority of the other agreements.  It is also anticipated that ComEd will seek a longer term easement at that time.

 

Due to a reported short construction schedule for this project, there was a need that the easement be issued prior to the Board Meeting of August 12, 2010.  As an accommodation to the Corps, the Executive Director on July 16, 2010, issued and executed the Easement on behalf of the District.

 

An easement fee of $26,110.00 is recommended based upon easement fees assessed for other Com Ed lines on District land in the subject area.

 

It is requested that the Board of Commissioners ratify the Executive Director’s July 16, 2010 execution of a 1-year Easement to allow Commonwealth Edison to construct an electrical substation and to install overhead power lines upon and over District land located along the east bank of the Chicago Sanitary & Ship Canal south of the 135th Street Bridge in Romeoville, Illinois.  Consideration shall be $26,110.00.
