Dear Sir:

 

Since February 2002, the U. S. Army Corps of Engineers (“Corps”) has had an easement to construct and operate an aquatic Dispersal Barrier (“Barrier IIA”) on the Chicago Sanitary & Ship Canal (“CSSC”) north of the 135th Street Bridge in Romeoville, Illinois.  The Corps has commenced construction of another barrier - Barrier IIB - whose purpose is to provide redundancy and continued dispersal capacity during periods of maintenance and repair of Barrier IIA.  Said Barrier IIB requires additional electrical power for its operation.

 

To provide the needed electrical power, the Corps requests a 1-year Right-of-Entry (“ROE”) to access an approximately 80-foot wide by 260-foot long rectangular shaped area for construction of an electrical substation south of 135th Street Bridge that will provide electrical power to the Dispersal Barriers.  The electrical station will become the property of Commonwealth Edison (“ComEd”) upon completion and ComEd will be responsible to operate, repair, maintain, and remove the electrical transformer, substation, fences, and appurtenances.  By separate Board Letter of same date, ratification is sought granting ComEd a 1-year easement for the subject project.

 

The District’s technical departments reviewed and had no objections subject to protection of District facilities in the area.

 

Due to a reported short construction schedule for this project and the need for access prior to the District’s Board Meeting of August 12, 2010, the Executive Director on July 22, 2010 issued and executed the ROE on behalf of the District so that the project could remain on schedule.

 

Due to the short term of the ROE and the fact that the Corps intends to consolidate all its activities in the Barrier region in 2011, only a nominal fee of $10.00 is recommended for the ROE.

 

It is requested that the Board of Commissioners ratify the Executive Director’s July 22, 2010 execution of a 1-year Right-of-Entry to allow the United States Army Corps of Engineers to construct an electrical substation upon and over District land located along the east bank of the Chicago Sanitary & Ship Canal south of the 135th Street Bridge in Romeoville, Illinois.  Consideration shall be $10.00.
