Authority to Settle Property Damage Claim Against Stanley Rebacz Trucking, Inc. and Universal Casualty Co., in the amount of $21,219.19

Dear Sir:

 

On November 17, 2008, an employee of Stanley Rebacz Trucking, Inc. was driving a truck on LASMA Rd. at the Stickney Water Reclamation Plant and struck MWRD Locomotive No. 4, damaging the locomotive and a lysimeter. 

 

The District paid $21,219.19 to repair Locomotive No. 4.  The lysimeter was not operating at the time of the accident, is no longer involved in any monitoring program, and will not be repaired.

 

Universal Causality Co., Rebacz Trucking’s insurance carrier, has agreed to settle this matter for the full value of the repairs to Locomotive No. 4.  It is submitted that settlement of this matter in the total amount of $21,219.19 is in the best interest of the District. 

 

Therefore, the General Counsel requests that the Board of Commissioners approve the settlement of this case in the total amount of $21,219.19.  Further, the General Counsel requests authority to execute such documents as may be necessary to effectuate this settlement.
