Authority to Settle Interboro Packaging Corp. v. MWRDGC, Case No. 05 L 10949, in the Circuit Court of Cook County, Illinois

Dear Sir:
On December 16, 2004, the District awarded needs-based Contract No. 05-006-11 to Interboro Packaging Corp with an estimated value of $37,500.00.
The District awarded the Contract to Interboro Packaging Corp. ("Interboro") with the understanding that Interboro would supply bags that met the District's contract specifications.
Since Interboro failed to supply such bags, the parties have been involved in extensive breach of contract litigation over the past five years. The Law Department recently defeated Interboro's claim for attorneys' fees on a motion for summary judgment. It is submitted that settlement of this matter in the total amount of $28,500.00 is in the best interests of the District.
Therefore, the General Counsel requests that the Board of Commissioners approve the settlement of this case in the total amount of $28,500.00. Further, the General Counsel requests authority to execute such documents as may be necessary to effectuate this settlement.
