TRANSMITTAL LETTER FOR BOARD MEETING OF SEPTEMBER 2, 2010

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Joseph Costello vs. MWRDGC, Case No. 09 WC 46302, Illinois Workers’ Compensation Commission, in the sum of $30,773.76, Account 901-30000-601090

Body

Dear Sir:

Joseph Costello is an Operating Engineer II at the Stickney Water Reclamation Plant.  On September 27, 2007, he twisted his left knee while hurrying down a staircase to respond to a pump failure situation.  He went to the Clearing Clinic and was diagnosed with a left knee sprain.  An MRI later revealed a medial meniscus tear.  Mr. Costello underwent surgery on October 30, 2007, to repair the tear.  The surgeon reported both medial and lateral meniscus tears were repaired.  Mr. Costello completed physical therapy.  He underwent a steroid injection for post-surgical pain.  He lost 83 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim can be settled for the sum of $30,773.76, which represents a 22-1/2% loss of use of the left leg.

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
