TRANSMITTAL LETTER FOR BOARD MEETING OF OCTOBER 7, 2010

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Earlean Harris vs. MWRDGC, File No. 200004326, Illinois Workers’ Compensation Commission, in the sum of $25,531.90, Account 901-30000-601090

Body

Dear Sir:

Earlean Harris is an MLA at the Stickney Water Reclamation Plant.  On January 15, 2009, she slipped on a snow covered stair in the scum building and injured her right ankle.  Ms. Harris went to Ingalls Memorial Hospital and was diagnosed with a right lateral malleolus fracture.  Her right ankle was casted.  She had extensive physical therapy after the cast was removed but continued to have pain.  An MRI scan demonstrated an osteochondral defect of the medial talar dome.  On July 29, 2009, she underwent right ankle arthroscopy with debridement and drilling of the osteochondral defect.  Ms. Harris completed additional physical therapy and returned to work on January 19, 2010.  She lost a year of work.

Subject to the approval of the Illinois Workers’ Compensation Act, this pro se claim can be settled for the sum of $25,531.90 which represents a 23% loss of use of the right foot.

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
