Dear Sir:

 

On December 2, 2009, the Executive Director authorized the Director of Procurement and Materials Management to issue a purchase order and enter into an agreement with Seyfarth Shaw LLP, for legal counseling and related services in connection with the matter of Doretha Jackson, in an amount not to exceed $1,750.00.

 

As of August 12, 2010, the attached list of change orders has been approved.  The effect of these change orders resulted in an increase in an amount of $8,690.00 from the original amount awarded of $1,750.00.  The current contract value is $10,440.00.  The prior approved change orders reflect a 496.5% increase to the original value.

 

Initially this matter involved internal complaints and an EEOC Charge filed in October 2009 by Ms. Jackson, then an Assistant Attorney for the District.  She resigned from the classified service effective close of business July 2, 2010.  Authorization is requested to expand the scope of the legal representation due to a new lawsuit filed by Ms. Jackson in the Circuit Court of Cook County against the District and four individual defendants, entitled Jackson v. Morakalis, Lowe, Feldman, Lanyon, and the MWRDGC, Case No. 2010L010509.  Ms. Jackson alleges constructive discharge as a result of her work environment during her two-year employment with the District. 

 

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed, and is in the best interest of the District.

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase the purchase order and amend the agreement in an amount of $30,000.00 (287.3% of the current contract value), from an amount not to exceed $10,440.00, to an amount not to exceed $40,440.00.

 

Funds are available in Account 101-30000-601170.
