Dear Sir:

 

Andrew Freeman is an MLAS in the Sewer Maintenance crew at the North Side Water Reclamation Plant.  On June 18, 2009, Mr. Freeman was crossing the street at Golf and Busse Roads in Mount Prospect to check a manhole.  A vehicle drove around the sewer truck, crossed over the crosswalk, and struck Mr. Freeman.  He was taken to Northwest Community Hospital and diagnosed with multiple contusions.  He reported severe left knee pain.  An MRI revealed medial and lateral meniscal tears.  On September 17, 2009, Mr. Freeman underwent surgery to repair the tears.  He completed a physical therapy program and returned to regular duties on December 9, 2009.  He lost 123 days of work.  Mr. Freeman filed a lawsuit with the insurance company of the driver of the vehicle that caused the accident.  The District filed a lien in that matter and pursuant to statute, the District will be entitled to a reimbursement of approximately 75% of payments made on the claim.  That matter is presently pending.

 

At this time, the Workers’ Compensation claim can be settled for the sum of $28,582.96 which represents a 20% loss of the left leg.

 

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

 

This settlement amount will be added to our lien.
