Authority to issue an 18-month permit to Albany Auto Sales to access, use, and maintain a 2,009 square-foot boat dock on District land located and adjacent to Albany Auto Sales property near 4020 North Rockwell in Chicago, along the North Branch of the Chicago River.  Consideration shall be $4,900.00

Dear Sir:

 

On December 3, 2009, the Board of Commissioners (“Board”) authorized the issuance of an 18-month permit to Albany Auto Sales (“Albany”), a recreational watercraft and motor vehicle repair business, with a permit fee of $4,700.00.  Albany’s permit has expired and it has requested a new 5-year permit.  The previous permit was for the purpose of accessing, using, and maintaining a 2,009 square foot boat dock in conjunction with its boat repair business.  The dock is located adjacent to Albany’s business at 4030 North Rockwell in Chicago.

 

Albany has operated its business at this location by permit since January 2004.  On August 14, 2003, the Board authorized the issuance of permits to cure over 20 years of unauthorized encroachment on and utilization of channel banks and the prism of the North Branch of the Chicago River between Belmont and Lawrence Avenues in Chicago.  Because the issuance of this permit may relate to the on-going Abec Litigation matter, an 18-month permit for the period July 22, 2010 through January 31, 2012 is being recommended to allow use of the dock in conjunction with Albany’s boat repair business until the Abec litigation is resolved and a long-term solution on the various dock issues is established.

 

The District’s technical departments have reviewed the request and have no objections to issuing a new permit.

 

The permit fee of $4,900.00 is based upon an 18-month permit period utilizing the rate under the previous permit and then increase it by an inflation rate of 3.5 percent.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize issuance of an 18-month permit to Albany Auto Sales to access, use, and maintain a 2,009 square-foot boat dock on District land located and adjacent to Albany Auto Sales property near 4020 North Rockwell in Chicago, along the North Branch of the Chicago River.  Consideration shall be $4,900.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said permit agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
