Dear Sir:
On June 15, 2000, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 77-235-AF Thornton Reservoir Vincennes Avenue Relocation to Zepeda Construction Company, in an amount not to exceed $3,930,608.59. The scheduled contract completion date was November 5, 2000.
This contract has no prior change orders.
This purchase order was kept open after the scheduled contract completion date due to litigation and property issues. The Law Department has been actively involved in handling both and a resolution is now pending. Since there is no further work to be performed under the contract and the pending resolution will not have any effect on the purchase order, it is now necessary to decrease and close this purchase order.
This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed, and is in the best interest of the District.
It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to decrease Contract 77-235-AF in an amount of $396,181.69 (10.08% of the current contract value), from an amount of $3,930,608.59, to an amount not to exceed $3,534,426.90.
Funds will be restored to Account 401-50000-645620.
