TRANSMITTAL LETTER FOR BOARD MEETING OF JANUARY 19, 2012

COMMITTEE ON JUDICIARY

Mr. David St. Pierre, Executive Director

Title

Authority to settle the Workers’ Compensation claim of Andrea Mucino v. MWRDGC, Case No. 11 WC 014113, Illinois Workers’ Compensation Commission (IWCC), in the sum of $28,323.56.  Account 901-30000-601090

Body

Dear Sir:

Andrea Mucino is a Pollution Control Technician II at the North Side Water Reclamation Plant who slipped on February 9, 2011, while getting out of a truck, injuring her right knee in the process.

Ms. Mucino initially saw the industrial physician who prescribed an MRI of the right knee which confirmed a medial meniscus tear, ACL sprain, MCL sprain, chondromalacia and fissuring joint effusion.

Ms. Mucino ended up treating with an orthopedic specialist, and on April 8, 2011, she underwent arthroscopic repair of the right knee.  The post-operative diagnosis was a right knee torn meniscus, chondromalacia of the patella, and a partial tear of the anterior cruciate ligament insertional cyst.

Following the surgery, Ms. Mucino underwent a course of physical therapy before returning to work.  She missed a total of 23 weeks of work.

Ms. Mucino filed a claim with the IWCC and is represented by an attorney.  Subject to the approval of the IWCC, this claim can be settled for the sum of $28,323.56, which represents 22.5% loss of use of the right leg.  This settlement closes out all future medical exposure related to this claim.

The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Ronald M. Hill, General Counsel, RMH:LAG:RG:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
