Dear Sir:
On December 6, 2007, the Board of Commissioners authorized the Purchasing Agent to advertise for bids for Contract 08-415-11 Installation of a Physical Security Video Surveillance System for the McMillan Pavilion Lobby, Main Office Building Board Room, Parking Area, Lobby and Alley.
In response to a public advertisement of March 19, 2008, a bid opening was held on April 29, 2008. The bid tabulation for this contract is:
TRI-ELECTRONICS, INC. $36,682.00
FE MORAN, INC. $48,832.00
JOHNSON CONTROLS, INC. $54,767.00
Two hundred thirty-seven (237) companies were notified of this contract being advertised and twenty-two (22) companies requested specifications.
The low bid submitted by Tri-Electronics, Inc., offered a DVR that does not support analog cameras, and only supports IP cameras, which does not comply with the specifications of this contract.
The second low bid, submitted by F.E. Moran, Inc., was contacted, in writing, requesting further information to confirm that the company would be able to perform the work as specified. A response was requested within 10 business days from their receipt of the letter. The certified letter was received on May 21, 2008. As of today, no response was ever received from F.E. Moran, Inc. Therefore, the bid was considered non-responsive and was rejected in the public’s best interest. The Purchasing Agent has notified F.E. Moran, Inc., of this action.
Johnson Controls Inc., the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for this contract was $56,600.00, placing the bid of $54,767.00, approximately 3.24 percent below the cost estimate.
Johnson Controls Inc., has executed the Multi-Project Labor Agreement certificate as required. It is anticipated that the following construction trades will be utilized on this contract: electricians. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions. In order for Johnson Controls to comply wit the Multi-Project Labor Agreement, they intend to subcontract to Low Voltage Concepts who is signatory to Local 134.
In view of the foregoing, it is recommended that the Purchasing Agent be authorized to award Contract 08-415-11, to Johnson Controls Inc., in an amount not to exceed $54,767.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Purchasing Agent. Funds are available in Account 101-15000-623990.
