Dear Sir:
Kenneth Lawrence is a Laborer Foreman who works at the Calumet Water Reclamation Plant. On November 4, 2010, he injured his left ankle and back at work. On November 11, 2010, he was diagnosed with a left ankle sprain and lower back strain. His treatment consisted of prescribed medications and physical therapy. On February 22, 2011, Mr. Lawrence was able to return to full duty work. He was paid a total of 15 weeks of lost time benefits for this injury.
On August 2, 2011, Mr. Lawrence sustained a new injury to his left shoulder at work. On December 1, 2011, he underwent arthroscopy for left shoulder labral tear and AC arthritis. He underwent post-surgical physical therapy. On January 9, 2012, he was able to resume restricted duty work. On March 19, 2012, Mr. Lawrence resumed regular duty work. He was paid a total of 5-1/2 weeks of lost time benefits for this injury.
Mr. Lawrence filed two Applications for Adjustment of Claim with the IWCC through his counsel. Subject to approval of the IWCC, these claims can now be settled for the sum of $52,447.63, which represents 2.5% loss of use of the left foot ($2,795.75) and 3% loss of use of the body as a whole ($10,044.60) for a total of $12,840.35 for the November 4, 2010, injury, and approximately 11.3% loss of use of the body as a whole ($39,607.28) for the August 2, 2011, injury. This settlement will close out any future lost time benefits as well as any future medical exposure on these claims.
The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
