COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, General Superintendent

Title

Authority to settle the Workers’ Compensation Claim of James Manning vs. MWRDGC, #06WC 19830, Illinois Workers’ Compensation Commission in the sum of $59,177.00.  Account 901-30000-601090

Body

Dear Sir:

James Manning is an Electrical Mechanic.  On February 9, 2006, while decommissioning electrical devices in a sample trailer, he slipped and fell on wet vinyl siding on the floor.  He went to Swedish Covenant Hospital and was diagnosed with a low back contusion.  He began experiencing left radiating leg pain.  An MRI on March 28, 2006 revealed an L4-5 left-sided disc herniation.  He underwent three epidural steroid injections with short term relief.  Manning had low back surgery on June 12, 2006.  He completed physical therapy and work conditioning programs and returned to work on October 16, 2006.  He lost 31 weeks of work.

Manning reported a second injury to his low back on October 15, 2007.  While moving office furniture to access electrical  boxes, he developed a sharp low back pain.  He went to Excel Occupational Health Clinic and was diagnosed with a low back strain.  He completed a physical therapy program.  He lost 44 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim covering both accidents can be settled for the sum of $59,177.00, which represents a 20% loss of the person as a whole.

The Attorney requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, Attorney, FMF:LAG:VMM:lrr

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
