Report on rejection of bids for Contract 08-881-12 Painting Services for the Battery B Final Settling Tanks at the Calumet Water Reclamation Plant, estimated cost $400,000.00

Dear Sir:

 

On November 15, 2007, the Board of Commissioners authorized the Purchasing Agent to advertise for bids, Contract 08-881-11 Painting Services for the Battery B Final Settling Tanks at the Calumet Water Reclamation Plant.

 

In response to a public advertisement of December 19, 2007, a bid opening was held on January 15, 2008.  All bids were rejected at the March 6, 2008 Board meeting.

 

In response to a public re-advertisement of March 12, 2008, a bid opening was held on April 8, 2008.  The bid tabulation for this contract is:

 

ERA VALDIVIA CONTRACTORS, INC.                     *$350,760.00

CROWN PAINTING, INC.                     *$402,300.00

ANCHOR MECHANICAL, INC.                     $566,764.00

NORTHWESTERN CONTRACTORS, INC.                     $700,000.00

Five hundred thirty (530) companies were notified of this contract being advertised and twelve (12) companies requested specifications.

 

The PCE utilization goals for this contract are 20 percent MBE, 10 percent WBE, and 10 percent SBE.

 

The low bid submitted by Era Valdivia Contractors, Inc., requested a full wavier of the 10 percent WBE goal.  The Affirmative Action Administrator reviewed the wavier request and denied the waiver, indicating Era Valdivia Contractors, Inc., did not provide a “Good Faith Effort” to attain WBE participation.  The Purchasing Agent concurred with this finding.  Therefore, Era Valdivia Contractors, Inc., has been notified that their bid is considered non-responsive and rejected in accordance with Appendix D, Section 9(b) (vii).

 

The second low bid submitted by Crown Painting, Inc., requested a full wavier of the 10 percent WBE goal.  The Affirmative Action Administrator reviewed the wavier request and denied the waiver, indicating Crown Painting, Inc., did not provide a “Good Faith Effort” to attain WBE participation.  The Purchasing Agent concurred with this finding.  Therefore, Crown Painting, Inc., has been notified that their bid is considered non-responsive and rejected in accordance with Appendix D, Section 9(b) (vii).

 

The third low bid submitted by Anchor Mechanical, Inc., did not submit the proper Subcontractor’s Letter of Intent (Exhibit B), as required for PCE’s listed in the Utilization Plan, within the three (3) day period allowed under Appendix D.  Therefore, Anchor Mechanical, Inc., has been notified that their bid is considered non-responsive and rejected in accordance with Appendix D, Section 8 (b).

 

The fourth low bid submitted by Northwestern Contractors, Inc., is approximately 75% over the cost estimate for the contract and is considered too high.  The Purchasing Agent has notified Northwestern Contractors, Inc., that their bid has been rejected in the public’s best interest.

 

The contract will be reviewed prior to re-advertisement.
