Title

Authority to grant a 5-year, 20-foot x 383-foot, non-exclusive aerial easement to Unite Private Networks, LLC, to cross with a fiber optic cable the Cal-Sag Channel at Pulaski Road in Alsip, Illinois.  Consideration shall be an initial annual fee of $2,000.00

Dear Sir:

 

Unite Private Networks-Illinois, LLC, (“UPN”) has requested a 20-foot x 383-foot aerial easement to cross District land with a fiber optic cable extending from Cal-Sag Channel Atlas Parcel 12.06 across the Cal-Sag Channel along the west side of the bridge located at Pulaski Road and extending through Cal-Sag Channel Parcel 12.04 located on the north side of the Cal-Sag Channel at Pulaski Road in Alsip, Illinois. 

 

The proposed aerial crossing will follow existing ComEd transmission lines.  The Easement will only grant permission to cross the District’s land; the Grantee must obtain separate authority from ComEd to attach its cables to ComEd’s poles at the subject locations.

 

The District’s technical departments have reviewed the request and have no objections thereto.  UPN will be required to provide general liability, property damage and environmental contamination insurance and to post a performance bond in accordance with the District’s standard requirements.

 

An easement fee calculated in accordance with the District’s policy will yield a fee of less than $2,000.00.  Accordingly, staff recommends that the consideration shall be the District’s minimal initial annual fee of $2,000.00.

 

It is requested that the General Superintendent recommend to the Board of Commissioners that it grant a 5-year, 20-foot x 383-foot, non-exclusive aerial easement to Unite Private Networks-Illinois, LLC, to cross the District’s land with a fiber optic cable extending from Cal-Sag Channel Atlas Parcel 12.06 across the Cal-Sag Channel along the west side of the bridge located at Pulaski Road and extending through Cal-Sag Channel Parcel 12.04 located on the north side of the Cal-Sag Channel at Pulaski Road in Alsip, Illinois.  Consideration shall be an initial annual feel of $2,000.00.

 

It is further requested that the General Superintendent recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after same is approved by the Attorney as to form and legality.
