TRANSMITTAL LETTER FOR BOARD MEETING OF JANUARY 19, 2012

COMMITTEE ON REAL ESTATE

Mr. David St. Pierre, Executive Director

Title

Authority to grant a 25-year, non-exclusive 30-foot x 300-foot easement to the City of Crest Hill to continue to maintain, repair and operate a paved effluent outfall pipe on a portion of District Main Channel Parcel 13.04 in Crest Hill, Illinois.  Consideration shall be a nominal fee of $10.00.

Body

Dear Sir:

The City of Crest Hill (“Crest Hill”) uses, under a 25-year easement, a 30’ x 300’ portion of Main Channel Parcel 13.04 to maintain, repair and operate a paved effluent outfall channel to the Des Plaines River in Crest Hill, Illinois, to permit the discharge of effluent from the City of Crest Hill’s Wastewater Treatment Plant into the Des Plaines River.  Crest Hill has requested a new 25-year easement to continue to operate and maintain the paved effluent outfall channel at the subject location.

The District’s technical departments have reviewed the request and have no objections thereto.  A nominal fee is being recommended as Crest Hill is a municipal agency operating the outfall pipe for a public purpose.

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the grant of a 25-year, non-exclusive 30’ x 300’ easement to the City of Crest Hill to continue to maintain, repair and operate a paved effluent outfall pipe on a portion of District Main Channel Parcel 13.04 in Crest Hill, Illinois.  Consideration shall be a nominal fee of $10.00.

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.

Requested, Ronald M. Hill, General Counsel, RMH:STM:NPE:rg

Recommended, David St. Pierre, Executive Director

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Real Estate Development
