Dear Sir:

 

In connection with the North Side Sludge Pipeline Replacement Section 1, NSA (Contract 07-O27-3SR), it is necessary to acquire an approved Highway Permit application form from the Illinois Department of Transportation (IDOT) for work along Devon Avenue in the Village of Lincolnwood. As part of the permit approval process, IDOT required the District to notify and obtain consent from all property owners along Devon Avenue that the project would impact because of temporary driveway closures.

 

On June 29, 2020, the owner of 3300 W. Devon Avenue, Bakesweet Corp. Libanais Sweets (“Bakesweet”), gave its consent for temporary closure of its private driveway, in exchange for $9,500.00, representing Bakesweet’s potential lost profits. As a condition of its consent, Bakesweet required the District to restrict work on the weekends and work to be performed between August 15th and October 15th, to ensure that one driveway is always open to its parking lot, and to be responsible for cleaning any excavation debris in Bakesweet’s parking lot. After this last consent was obtained, IDOT granted the District the necessary permit for the project on August 12, 2020.

 

The contract was advertised on August 26, 2020 and bids were received on November 10, 2020. However, all bids were rejected due to the volatility in the market of construction materials and supplies.

 

As such, the Engineering Department prepared documents to re-advertise under Contract 07-027-3SR, as reported to the Board on December 2, 2021. However, IDOT requires the District to obtain a new permit due to the passage of time. IDOT is also requiring the District to obtain updated consent from the property owners along Devon Avenue that the project will impact because of temporary driveway closures, including Bakesweet.

 

In exchange for its consent, Bakesweet requires an additional $4,750.00, due to the potential interruption and an increase in the cost of goods and services.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it approve and authorize the Director of Engineering to make payment to Bakesweet Corp. Libanais Sweets, for the North Side Sludge Pipeline Replacement Section 1, NSA (Contract 07-027-3SR), to meet the Illinois Department of Transportation’s permit requirements in the amount of $4,750.00.

 

Funds are available in Account 401-50000-667340.
