Authority to grant a 25-year, 666 sq. ft. non-exclusive easement to Comcast of Illinois IV, Inc. to continue to operate an aerially suspended cable television transmission line on District real estate located south of Emerson Street between McCormick Boulevard and Leland Avenue in Evanston, Illinois.  Consideration shall be an initial annual fee of $5,000.00

Dear Sir:

 

Since January 1, 1998, Comcast of Illinois IV, Inc. (“Comcast”) has operated and maintained an aerially suspended cable television transmission line and appurtenances thereto attached to poles owned by Commonwealth Edison Company and AT&T within the perimeter of an approximately 666 sq. ft. area of District real estate located south of Emerson Street between McCormick Boulevard and Leland Avenue across the North Shore Channel in Evanston, Illinois, and known as North Shore Channel Parcel Nos. 3.03 and 3.05, under an easement which expires December 31, 2022. 

 

Comcast has now requested a new 25-year easement to continue to operate and maintain its aerially suspended cable television transmission line crossing the North Shore Channel at the subject location.  North Shore Channel Parcel 3.03 is under lease to the City of Evanston and North Shore Channel Parcel 3.05 is under lease to the Village of Skokie for public recreational purposes.

 

The District's technical departments have reviewed the subject request and have no objections to the easement.  It is recommended that an initial annual easement fee of $5,000.00 be assessed for the 25-year easement as the pro-rata share of 10% of the fair market value of the easement premises would yield a fee less than the District's minimum fee of $5,000.00.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, 666 sq. ft. non-exclusive easement to Comcast of Illinois IV, Inc. to continue to operate an aerially suspended cable television transmission line on District real estate located south of Emerson Street between McCormick Boulevard and Leland Avenue in Evanston, Illinois.  Consideration shall be an initial annual fee of $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.
