Authority to negotiate and execute an amendment to the Agreement with the Village of Tinley Park, Illinois to include a property with approximately 80 acres within the Village of Tinley Park in Will County

Dear Sir:

 

On October 20, 1977, the Board of Commissioners (Board) authorized the negotiation of an agreement between the District and the Village of Tinley Park (Village) to use the District’s collection and treatment facilities.

 

On May 18, 1978, the District entered into an Agreement with the Village to use the District’s facilities for sewage and industrial wastes originating on and discharging from an area of land consisting of approximately 1200 acres of property bounded by 191st Street, 183rd Street, Harlem Avenue and 80th Avenue, and also bounded by Interstate 80, 183rd Street, 80th Avenue and 96th Avenue, located in in Will County.

 

On June 6, 1991, the Board authorized execution of an amendment to the agreement entitled “Settlement Agreement”, which clarified payments made under the original Agreement.

 

On February 5, 2004, the Board authorized an amendment to the agreement entitled “Amendment to Sewer Service Agreement”, which added approximately 8.66 acres of property that was inadvertently omitted from the service area.

 

On December 15, 2011, the Board authorized an amendment to the agreement entitled “Third Amendment to Sewer Service Agreement with Tinley Park, Illinois” (“Third Amendment”), which identified the responsible party for certain pretreatment program responsibilities and obligations per USEPA requirements.

 

The Village currently wishes to amend the Agreement as modified by the Third Amendment to include the property within the Village in Will County that is bounded by 191st Street, 76th Avenue and Harlem Avenue, extends approximately 1320 feet south of 191st Street, and has a property area of approximately 80 acres (“Property”). The amendment would allow sewage and industrial wastes originating on the Property to be serviced by District’s collection and treatment facilities.

 

It is respectfully requested that the Board of Commissioners grant authority to negotiate and execute an amendment to the Agreement with the Village. It is further requested that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said intergovernmental agreement on behalf of the District upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
