Dear Sir:
Authority is requested to amend the intergovernmental agreement (IGA) with the Village of Lyons (Village) for the acquisition of flood-prone properties in Lyons, SSA (21-IGA-24) and increase the purchase order to an amount not to exceed $5,500,000.00.
On June 2, 2022, the Board of Commissioners (Board) granted authority to enter into an IGA with and make payment to the Village for the acquisition of flood-prone properties, in an amount not to exceed $3,000,000.00. The IGA between the District and the Village was fully executed on October 7, 2022. Under this project, the Village originally proposed to acquire twenty-five flood-prone properties along Salt Creek. On October 19, 2023, the Board granted authority to amend the IGA to include an additional flood-prone parcel to the original list of eligible properties. However, only $3,000,000.00 was available through the District’s Voluntary Flood-Prone Property Acquisitions program to fund the acquisitions under this partnership at that time. The Village has acquired seven flood-prone properties with a total contribution of $2,437,500.00 of District funds to date, with one additional acquisition in progress estimated at $440,000.00. In order to continue acquiring the remaining identified flood-prone parcels, the Village submitted an application to the District, as detailed in the Report on Flood-Prone Property Acquisitions Program Submittals presented to the Board on April 17, 2025, to increase our funding in an amount of $2,500,000.00.
In order to proceed efficiently, an amendment to the existing maximum reimbursement amount under the current IGA is being requested. The proposed revision would be to increase the maximum reimbursement amount by the District from $3,000,000.00 to $5,500,000.00. The Village has confirmed it is committed to continuing with the acquisition of flood-prone properties along Salt Creek if the IGA can be amended.
Based on the foregoing, it is recommended that the District be authorized to increase the purchase order in an amount of $2,500,000.00, from an amount of $3,000,000.00, to an amount not to exceed $5,500,000.00, for the subject project and amend the IGA with the Village. It is requested that the Board of Commissioners authorize and direct the Chairman of the Committee on Finance and Clerk to execute the amendment to the IGA after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
Funds for this project are subject to appropriation in 2025 and 2026 in Account 501-50000-612400. Funds in the amount of $800,000.00 are anticipated to be spent in 2025, and $1,700,000.00 in 2026. Funds requested in future years are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
