Authority to issue a one-month permit to Nicor Gas Company to perform soil borings and survey work on District Main Channel Parcels 26.01, 26.04, 26.05, 27.01 and 28.01. Consideration shall be $2,500.00

Dear Sir:
 
Nicor Gas Company ("Nicor") has requested to enter District real estate in Willow Springs to conduct soil borings and perform survey work as part of its due diligence in assessing whether to install a  natural gas pipeline through an approximate two-mile stretch of District properties commencing at Nicor's existing gas facilities near the confluence of the Cal-Sag Channel and Main Channel and running easterly through District Main Channel Parcels 26.01, 26.04, 26.05 and 27.01 to service the Rowell Chemical leasehold on Parcel 28.01. The parcels are located between the Main Channel and the Illinois and Michigan Canal.  
 
Nicor will perform four (4) soil borings to determine the subsurface conditions (soil types, groundwater level, etc.) to assist in the engineering and construction of the proposed pipeline. The work area for each boring will comprise of approximately 500 square feet.  Parcel 26.01 is under lease to Full Circle Shipyard, LLC,  Parcel 26.04 is under lease to Holcim (US) Inc., Parcels 26.05 and 27.01 are under lease to Full Circle Repair, LLC,  and Parcel 28.01 is under lease to Rowell Chemical Corporation.  Accordingly, the permit (and ultimately any easement grant) is subject to the consent of Full Circle Shipyard, LLC, Full Circle Repair, LLC, Holcim (US) Inc., and Rowell Chemical Corporation.
 
The District's technical departments have reviewed Nicor's request to perform soil borings and have no objections thereto.
 
A fair market value fee of the permit premises would yield a fee less than the District's minimum $2,500.00 fee.  The District's standard minimum fee of $2,500.00 is therefore recommended.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the issuance of a one-month permit to Nicor Gas Company to perform soil borings and survey work on District Main Channel Parcels 26.01, 26.04, 26.05, 27.01 and 28.01. Consideration shall be $2,500.00.
 
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said permit agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
