On May 2, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 24-109-11, Furnish and Deliver a Gel Permeation Chromatograph System in the Organic Compounds Analytical Laboratory at the Egan Water Reclamation Plant.
In response to a public advertisement of June 5, 2024, a bid opening was held on June 25, 2024. On September 5, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 24-109-11, Furnish and Deliver a Gel Permeation Chromatograph System in the Organic Compounds Analytical Laboratory at the Egan Water Reclamation Plant, to Bio-Rad Laboratories, Inc. (Bio-Rad) in an amount not to exceed $43,970.02.
The Monitoring and Research Department (M&R) has informed Procurement and Materials Management that Bio-Rad Laboratories, Inc. (Bio-Rad) delivered the system on October 22, 2024. Upon inspection of the delivery, the system delivered did not contain an autosampler with the Gel Permeation Chromatograph System which is required. M&R contacted Bio-Rad representatives about this matter. Bio-Rad indicated that they do not manufacture an autosampler to pair with their system, but for an additional cost can provide an autosampler.
The contract documents required an autosampler in the specification and proposal pages. Therefore, Bio-Rad failed to comply with the contract specifications.
Therefore, the Director of Procurement and Materials Management has advised Bio-Rad Laboratories, Inc. that their contract will be forfeited for not adhering to the specifications of the contract. In accordance with Section 70 ILCS 2605/11.11 of the Purchasing Act, Bio-Rad will not be considered a responsible bidder for a one-year period.
