TRANSMITTAL LETTER FOR BOARD MEETING OF NOVEMBER 5, 2026
COMMITTEE ON PROCUREMENT
Mr. John P. Murray, Executive Director
Title
Authorization to enter into an agreement for Contract 26-RFP-01 Energy Curtailment Services, with Voltus, Inc. to provide energy curtailment services
Body
Dear Sir:
Authorization is requested to enter into an agreement for Contract 26-RFP-01, Energy Curtailment Services, with Voltus, Inc. to provide energy curtailment services for the District for a three (3) year period. These services are currently provided by Enerwise Global Technologies, LLC d/b/a CPower under Contract 20-RFP-17, which expires at the end of the 2026-27 curtailment season on May 31, 2027.
Contract 26-RFP-01, Energy Curtailment Services, was advertised on June 17, 2026. Six (6) proposals were received on July 24, 2026 from BP Energy Retail Company, LLC, Enerwise Global Technologies, LLC d/b/a CPower, Gridbeyond, LLC, NuEnergen, LLC, Rodan Energy Solutions USA, and Voltus, Inc.
A review committee comprised of members from the Maintenance and Operations Department, Law Department, and Procurement Department evaluated all proposals in accordance with the criteria established in the proposal documents. Proposer interviews were conducted from September 14 to 25, 2026.
All firms were subsequently invited to submit Best and Final Offers (BAFOs) by Wednesday, October 14, 2026. The BAFOs were evaluated based on the total projected revenue returned to the District through participation in the Emergency Load Response Program (ELRP). Under the ELRP, administered by PJM, the District may earn revenue for being available to reduce electrical load during grid emergencies and for verified load reductions when emergency events occur.
Under the proposed terms submitted by Voltus, Inc., the District will receive 105 percent of the cleared capacity payments, meaning Voltus will remit the full value of the District’s cleared capacity revenue plus an additional five percent. The District will also receive 94 percent of any energy payments resulting from emergency curtailment events registered through Voltus. This revenue structure was incorporated directly into the District’s financial evaluation during the BAFO scoring process.
Based on the evaluation described above, and in as much as Voltus, Inc. offers the greatest return of curtailment revenue to the District, it is recommended that the Director of Procurement and Materials Management be authorized to enter into an agreement per Section 11.4 of the Purchasing Act.
Requested, Edward J. Staudacher, Director of Maintenance and Operations, MFM
Recommended, Darlene A. LoCascio, Director of Procurement and Materials Management
Respectfully Submitted, Precious Brady-Davis, Chairperson Committee on Procurement
Disposition of this agenda item will be documented in the official Regular Board Meeting Minutes of the Board of Commissioners for November 5, 2026
