Dear Sir:
On August 13, 2026, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 27-348-11, Services to Remove Hazardous Materials from Various District Locations, On an As-Needed Basis, For A Three-Year Period.
In response to a public advertisement of September 2, 2026, a bid opening was held on September 29, 2026. The bid tabulation for this contract is:
LUSE ENVIRONMENTAL SERVICES, INC. $282,011.00
The quantities specified in the contract documents were used for the purpose of comparing bids and establishing unit prices. The total amount to be expended on this contract, should usage differ from the quantities, is not to exceed $275,000.00.
The Director of Procurement and Materials Management has reviewed the bidders’ list for this contract and is satisfied that the market for this service has been adequately solicited. A planholders’ survey revealed the following reason for not bidding: could not provide the services required. In light of these findings, the Director of Procurement and Materials Management is of the opinion that the bid received is a fair and reasonable price, and nothing would be gained by rejecting the sole bid and re-advertising this contract.
Luse Environmental Services, Inc. (Luse), the sole bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for this contract was $275,000.00, placing the bid of $282,011.00, approximately 2.5% above the engineer’s estimate.
The Affirmative Action Ordinance Revised Appendix D and Appendix V goals for this contract are 15% Minority Business Enterprise (MBE) and/or Women Business Enterprise (WBE), and 3% policy goal for the Veteran-Owned Business Enterprise (VBE).
Luse is in compliance with the Affirmative Action Ordinance Revised Appendix D and Appendix V as indicated on the attached report. The bidder has committed to the following utilization goals for this contract: 10% MBE and 5% WBE. Bidder provided 3% for VBE policy goal participation.
Luse has executed the Multi-Project Labor Agreement (MPLA) Certificate as required. It is anticipated that the following trades will be utilized in this contract: laborers. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The contract will require approximately two to four (2-4) people for the services.
The contract will start approximately on January 1, 2027, and end on December 31, 2029, or upon expenditure of available funds, whichever occurs sooner.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 27-348-11 to Luse in an amount not to exceed $275,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds for the 2027 expenditure are being requested in the 2027 budget in the amount of $92,500.00, in Account 101-25000-612780. The estimated expenditures for 2028 and 2029 are $92,500.00 and $90,000.00, respectively. Funds for the 2027, 2028, and 2029 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
