Dear Sir:

 

On February 15, 2018, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 13-370-3F, Buffalo Creek Reservoir Expansion, Lake County, Illinois, to Lake County Grading Company, LLC, Inc., in an amount not to exceed $9,678,900.00, plus a five (5) percent allowance for change orders in an amount of $483,945.00, for a total amount not to exceed $10,162,845.00. The scheduled substantial completion date is October 30, 2020, and the scheduled contract completion date, following the native vegetation establishment period, is March 14, 2025.

 

As of July 17, 2020, the attached list of change orders has been approved. The effect of this change order resulted in an increase in the amount of $36,730.85 from the original amount awarded of $9,678,900.00. The current contract value is $9,715,630.85. The prior approved change order reflects a 0.38 percent increase to the original contract value.

 

The contract bid documents identified several staging areas and access routes for use during various stages of construction. The contract bid documents show these areas to be restored with seed and erosion control blanket and to be monitored and managed in compliance with the U.S. Army Corps of Engineers’ (USACE) 3-year establishment requirements. Not all potential staging and access routes were used during the course of construction and several areas were left undisturbed. Therefore, the District received approval from the USACE and the Lake County Forest Preserve District to remove these areas from the contract landscaping plan. The contractor submitted a cost proposal (CO-01) for a credit in the amount of $117,672.00. The engineer reviewed the proposal, found it reasonable, and stated via correspondence CO01, that the Engineering Department would recommends its approval.

 

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed and is in the best interest of the District.

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to decrease Contract 13-370-3F in an amount of $117,672.00 (1.21 percent of the current contract value), from an amount of $9,715,630.85, to an amount not to exceed $9,597,958.85.

 

Funds will be restored to Account 401-50000-645620.
