Dear Sir:
On November 21, 2024, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 25-655-11 Manhole and Infrastructure Repairs.
In response to a public advertisement of January 29, 2025, a bid opening was held on March 3, 2025. The bid tabulation for this contract is:
SUMIT CONSTRUCTION CO., INC. $1,175,000.00
AIRYS INC. $2,746,200.00
The quantities specified in the contract documents were used for the purpose of comparing bids and establishing unit prices. The total amount to be expended on this contract, should usage differ from the quantities, is not to exceed $1,200,000.00.
The associated goals for this contract are 17% Minority Business Enterprise (MBE), 6% Women Business Enterprise (WBE), and 3% policy goal for the Veteran-Owned Business Enterprise (VBE).
Sumit Construction Co., Inc., the lowest responsible bidder, is proposing to perform the contract in accordance with the specifications. The estimated cost for the contract was $1,200,000.00, placing their bid of $1,175,000.00 approximately 2.1 percent below the engineer’s estimate.
Sumit Construction Co., Inc., has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following construction trades will be utilized on this contract: laborers, carpenters, brick masons, and operating engineers. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The contract will require approximately three (3) people for the services.
Sumit Construction Co., Inc., is in compliance with the Affirmative Action Ordinance, Revised Appendix D, as indicated in the attached report. The Minority Business Enterprise (MBE), and Women Business Enterprise (WBE) utilization goals for this contract are 17 percent MBE and 6 percent WBE participation. The bidder offered 0 percent for VBE participation.
The contract will commence upon approval of the contractor’s bond and terminate thirty-six (36) months thereafter, or upon expenditure of available funds, whichever occurs sooner.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 25-655-11 to Sumit Construction Co., Inc., in an amount not to exceed $1,200,000.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds for the 2025 expenditures, in the amount of $300,000.00, are available in Account 101-66000-612600. The estimated expenditures for 2026 are $420,000.00, 2027 are $420,000.00, and 2028 are $60,000.00. Funds for the 2026, 2027, and 2028 expenditures are contingent on the Board of Commissioners’ approval of the District’s budget for those years.
