Authority to settle the Workers’ Compensation Claim of Nitin Shukla vs. MWRDGC, Claim number 25WC007300 Illinois Workers’ Compensation Commission (IWCC), in the sum of $165,000.00, Account 901-30000-601090

Dear Sir:

 

Nitin Shukla was an Electrical Instrument & Testing Mechanic at the Kirie Water Reclamation Plant. He retired from the District effective June 1, 2025. On January 18, 2023, it was reported that he fell from a ladder while working on an actuator valve. Mr. Shukla was transported to the Emergency Room via ambulance. He was diagnosed with a left hip fracture.

 

Mr. Shukla had a total left hip replacement on January 19, 2023. He was off work starting on January 19, 2023, and returned to work on April 17, 2023. He was off work again on December 25, 2023.

 

In January 2024, Mr. Shukla was found to be at maximum medical improvement. He completed a program of work conditioning in February. In March, it was determined that Mr. Shukla had permanent restrictions. He remained off work until his retirement on May 31, 2025.

 

Mr. Shukla was paid 89.9 weeks of lost time benefits totaling $138,171.35.

 

Mr. Shukla filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can be settled for $165,000.00 representing approximately 33.05% loss of a person as a whole. This settlement will close out any future lost time and medical benefits.

 

The Acting Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
