Dear Sir:
Authority is requested to negotiate and enter into an Intergovernmental Agreement (IGA) with Cook County (County) and Palatine Township (Township), with payment to the County, for the Acquisition of Flood-Prone Properties in Palatine Township, NSA (20-IGA-26) in an amount not to exceed $600,000.00.
The Engineering Department solicited proposals between December 2019 and February 2020 from municipalities, townships, and other governmental agencies for District assistance to acquire flood-prone properties. From this solicitation, the Township’s application was one of five projects identified that met the requirements of the District’s policy.
The flood-prone properties identified by the Township in its application were recommended by the Engineering Department for acquisition, and on May 7, 2020, the Board of Commissioners granted authority to negotiate an IGA with Palatine Township. During negotiations it was determined the Township did not have the financial capacity to conduct the acquisition transactions. The County indicated they could provide assistance to facilitate the transactions, so they were added to the IGA negotiations.
The Township, County, and District have agreed in principle to the terms of the IGA, which include payment by the District towards the acquisition of three flood-prone properties depicted in the attached exhibit, in an amount not to exceed $600,000.00. The terms of the IGA also require the Township to obtain appraisals, prepare an offer, perform closing, deconstruct the purchased structure, restore the property to open space, and ensure long-term maintenance of the property. The County will provide the necessary funding to facilitate the acquisitions. The District will reimburse the County after the acquisitions are complete and the necessary closing documents and recorded deed restrictions are provided. The Township anticipates acquiring the property in 2023.
Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate and enter into an IGA with the County and Township, with payment to the County, in an amount not to exceed $600,000.00. It is further requested that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said IGA on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
