Authority to negotiate an Intergovernmental Agreement with the Village of Richton Park, for the design, construction, operation, and maintenance of Butterfield Creek Tributary Improvement Project in Richton Park (26-IGA-11)

Dear Sir:
Authorization is requested to negotiate an Intergovernmental Agreement (IGA) with the Village of Richton Park (Village), for the design, construction, operation, and maintenance of Butterfield Creek Tributary Improvement Project (26-IGA-11).
The District accepted proposals from municipalities, townships and other governmental agencies seeking assistance through the District’s Stormwater Partnership Program between August 2025 and March 2026, and as a result the Butterfield Creek Tributary Improvement Project was prioritized for partnership with the District.
The proposed project is the second phase of a multi-phase project and includes the construction of a new 26-acre-foot stormwater detention basin to be connected to an existing basin via an equalizer pipe, as depicted in the attached exhibit. The project is expected to mitigate flooding in the project area, benefiting 12 structures and providing additional benefits by reducing roadway flooding along Butterfield Creek near the intersection of Sauk Trail and Governors Highway.
The terms of the IGA will require the Village to assume responsibility for the final design, construction, operation, and maintenance of the project, with the District providing funding for a portion of the construction costs. Total funding assistance to be provided by the District will be finalized during negotiations between the District and the Village. The IGA will also require the Village to advertise and award the construction contracts in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement, and Affirmative Action Requirements.
Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to negotiate an IGA with the Village. Authority to enter into the IGA with the Village will be sought from the Board of Commissioners after negotiations have been finalized.
