TRANSMITTAL LETTER FOR BOARD MEETING OF JUNE 19, 2008
COMMITTEE ON REAL ESTATE
Mr. Richard Lanyon, General Superintendent
Title
Authority to issue a 5-year Permit extension to the County of Fulton for continued use of 440 acres of District real estate located on the former Wier Farm to maintain and operate a public fishing and recreational area in Fulton County, Illinois. Consideration shall be a nominal fee of $10.00
Body
Dear Sir:
Since 1972, the County of Fulton has been using under short term permit agreements approximately 440 acres of District real estate located on the former Wier Farm in Fulton County, Illinois, as a public fishing and recreational area. On December 2, 2004, the Board authorized the most recent extension of the subject permit for another 5 years commencing January 1, 2005 and ending December 31, 2009.
Fulton County has requested that the permit agreement be extended for 5 more years because Fulton County would like to install showers at the camp ground site. Prior to making the appropriation of funds, Fulton County wants to make sure that its interests in the premises will continue for a reasonable period of time thereafter to justify its investment. Accordingly, it makes its request for an extension earlier than usual.
The District’s technical departments have reviewed the request for the 5-year permit extension and have no technical objections.
The County’s use of the premises will be subject to all the District’s standard permit requirements, including insurance coverage, and any improvements to the property first shall be reviewed and approved by the District.
It is requested that the General Superintendent recommend to the Board of Commissioners that it authorize the extension of the 5-year Permit to the County of Fulton for continued use of 440 acres of District real estate located on the former Wier Farm to maintain and operate a public fishing and recreational area in Fulton County, Illinois. Consideration shall be a nominal fee of $10.00.
It is also respectfully requested that the General Superintendent recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said Permit Extension Agreement in behalf of the District after it is approved by the Attorney as to form and legality.
Requested, Frederick M. Feldman, Attorney, FMF:CL:JCC:MIM:nm
Recommended, Richard Lanyon, General Superintendent
Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Real Estate Development
ORDERED passed by affirmative roll call vote of a majority of the Commissioners present this June 19, 2008. Approved, President Terrence J. O’Brien
