Dear Sir:
Authorization is requested to enter into an Intergovernmental Agreement (IGA) with and make payment to Leyden Township (Township) for the design, construction, operation and maintenance of the Diversey Avenue Drainage Improvements under Phase II of the Stormwater Management Program, in Unincorporated Cook County, Illinois (18-IGA-29).
On May 17, 2018, the Board of Commissioners authorized the District to begin negotiations with several entities, including Leyden Township, for IGAs that would include provisions allowing for the District to provide funding towards the construction of various shovel ready stormwater projects. The Township’s proposed project consists of upsizing an existing ditch and culvert system with a new trunk storm sewer along the Diversey Avenue right-of-way in Leyden Township. Upon completion of the new trunk line, the project will provide flood reduction benefits to an estimated 30 structures, and after additional lateral storm sewer connections are built by the Township, a total of 250 structures will be provided with protection during future flood events. The District and the Township have agreed in principle to the terms of the IGA, which include payment by the District towards construction costs of the captioned project in an amount not to exceed $350,000.00. Partial payments to the Township will be made at predefined intervals during construction, which is anticipated to commence in 2018. The Township has spent approximately $50,000.00 on engineering and other design-related project costs, and will contribute approximately $35,250.00 towards construction costs of the trunk sewer installation. The IGA will require the Township to advertise and award the construction contract in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement and Affirmative Action Requirements, assume responsibility for design, construction, perpetual maintenance and operation of the project, and be solely responsible for any change orders to the project. The IGA also contains provisions which allow the District to perform inspections after the project is constructed.
Based on the foregoing, it is requested that the Board of Commissioners grant authority to enter into an IGA with the Township and make payment to the Township in an amount not to exceed $350,000.00. It is further requested that the Chairman of the Committee on Finance, Acting Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
Funds for the 2018 expenditure, in the amount of $350,000.00, are available in Account 501-50000-612400.
