Authority to issue a 5-year permit extension to Waste Management of Illinois, Inc. to continue to install, maintain, operate and remove monitoring wells and perform any necessary environmental remediation on District real estate located at 2025 E. 134th Street in Chicago, Illinois. Consideration shall be an annual fee of $5,000.00

Dear Sir:
Waste Management of Illinois, Inc. (“Waste Management”) owns a recycling, disposal and landfill facility located at 138th and Interstate 94 in Calumet City. The facility is located adjacent to and south of District real estate located at 2025 E. 134th Street in Chicago, Illinois. The Waste Management facility has been closed for several years and is under a long-term post-closure monitoring program. Among other measures, IEPA required Waste Management to install several groundwater monitoring wells on District property around the perimeter of the landfill for the purpose of monitoring groundwater quality.
On October 6, 2011, the Board of Commissioners issued a permit to Waste Management to install, maintain, operate and remove monitoring wells and perform any necessary environmental remediation on District real estate at the subject location. As extended, the permit expires October 16, 2026.
Waste Management has requested a 5-year permit extension to continue to maintain its monitoring wells along the perimeter of the District’s property. The subject property is currently under lease to the Chicago Park District (“Park District”) for public recreational use. The Park District has consented to this permit and Waste Management coordinates with the tenant as needed.
The technical departments have reviewed this request and have no objections to Waste Management’s continued access to the land for this purpose. The annual permit fee of $5,000.00 is based upon the District’s minimum annual fee since the permit area is of minimal size, and the pro-rata share of 10% of the fair market value of the land would yield a fee less than the District’s minimum fee of $5,000.00.
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 5-year permit extension to Waste Management of Illinois, Inc. to continue to install, maintain, operate and remove monitoring wells and perform any necessary environmental remediation on District real estate located at 2025 E. 134th Street in Chicago, Illinois. Consideration shall be an annual fee of $5,000.00.
It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit extension after same is approved by the General Counsel as to form and legality.
