Dear Sir:
Joseph Misheck was a Treatment Plant Operator II working at the Lemont Water Reclamation Plant. The employee has since retired from the District effective July 1, 2021. The employee reported that on November 2, 2020, while he was walking down a small hill after checking a tank, he slipped on wet grass falling such that his left leg bent backwards underneath his torso. The employee was initially taken by ambulance to Silver Cross Hospital due to an injury he sustained to his left knee. The employee was disabled from work effective November 3, 2020 and referred to an orthopedic specialist. On November 18, 2020, the employee underwent surgery on his left knee. Following his surgery, he underwent a course of physical therapy. He was able to return to work on March 15, 2021.
Mr. Misheck was off work for 18.80 weeks and was paid a total of $27,269.58.
Mr. Misheck filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can now be settled for a total of $56,226.59, representing approximately 30% loss of use of the left leg. This settlement will close out future lost time and medical benefits associated with this injury.
The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
