Body
Dear Sir:
Since May 6, 1999, Media One Acquisitions of Northern Illinois, Inc., n/k/a Comcast of Illinois IV, Inc. (“Comcast”), has operated and maintained a ½” diameter aerially suspended fiber optic cable and appurtenances thereto on Cal-Sag Channel (“CSC”) Parcels 8.04 and 8.09. The fiber optic cable runs parallel to Southwest Highway and traverses the Cal-Sag Channel between 114th Street and 117th Street in Cook County, Illinois. The current easement expires May 5, 2024, and the current annual easement fee is $5,867.40.
Comcast has requested a new 25-year easement to continue to operate and maintain its ½” diameter aerially suspended fiber optic cable and appurtenances thereto. CSC Parcel 8.04 is leased to the City of Palos Heights and CSC Parcel 8.09 is leased to the City of Palos Hills. The leases allow for public utility easements within the leaseholds.
The District’s technical departments have reviewed this request and have no objections thereto. Consideration shall be an initial annual fee of $13,082.00, which represents the fair market value.
It is requested that the Executive Director recommend to the Board of Commissioners that it grant Comcast of Illinois IV, Inc. a 25-year, approximately 15,391± sq. ft. non-exclusive easement to continue to operate a ½” diameter aerially suspended fiber optic cable and appurtenances thereto on District real estate located south of 114th Street and north of 117th Street in Cook County, Illinois; Cal-Sag Channel Parcels 8.04 and 8.09. Consideration shall be an initial annual fee of $13,082.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
Requested, Susan T. Morakalis, General Counsel, STM:BJD:KHY:vp
Recommended, Brian A. Perkovich, Executive Director
