Dear Sir:
On March 16, 2023, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids Contract 23-684-21, Equipment Painting & Rehabilitation at Various Locations.
At the Board Meeting of April 6, 2023, authorization was granted to revise the Authority to Advertise Board Letter as reported.
In response to a public advertisement of May 31, 2023, a bid opening was held on June 27, 2023. At the Board meeting of August 10, 2023, Groups E and F were awarded and Groups A, B, C, and D rejected as reported.
In response to a public re-advertisement of August 23, 2023, a bid opening was held on September 19, 2023. The bid tabulation for this contract is:

The Affirmative Action Ordinance, Revised Appendix D goals for this contract are 20 percent Minority Business Enterprise (MBE), 10 percent Women Business Enterprise (WBE), and 3 percent Veteran-owned Business Enterprise (VBE) for each group.
Capital Industrial Coatings, LLC (Capital) the lowest responsible for Groups A, B, and C is proposing to perform the contract in accordance with the specifications. The estimated cost of this contract for Groups A, B, and C is $4,052,942.00, placing their total bid of $3,323,680.00 approximately 18 percent below the estimate.
Capital is in compliance with the Affirmative Action Ordinance, Revised Appendix D as indicated on the attached report for Groups A, B, and C. The Minority Business Enterprise (MBE), Women Business Enterprise (WBE) and Veteran-owned Enterprise (VBE) utilization goals for this contract are as follows: Group A, 20 percent MBE, 10 percent WBE, and 3 percent for VBE participation; Group B, 20 percent MBE, 10 percent WBE, and 3 percent for VBE participation; and Group C, 20 percent MBE, 10 percent WBE, and 3 percent for VBE participation.
Capital has executed the Multi-Project Labor Agreement (MPLA) certificate as required. It is anticipated that the following construction trades to be utilized on this contract are painters, laborers, and truck drivers. The list of construction trades is not intended to confer any rights or jurisdiction upon any union or unions.
The contractor shall provide the specified painting services commencing upon approval of the Contractor’s Bond and complete the work for Groups A,B, and C by December 31, 2025.
The contract will require approximately twenty-four (24) people for the services.
Group D is under review.
In view of the foregoing, it is recommended that the Director of Procurement and Materials Management be authorized to award Contract 23-684-22, Groups A, B, and C to Capital in an amount not to exceed $3,323,680.00, subject to the contractor furnishing a performance bond in form satisfactory to the Law Department and approved by the Director of Procurement and Materials Management.
Funds are being requested in Accounts 101-67000/68000/69000-612650 for the 2024 and 2025 budget years in the amounts of $1,661,840.00 and $1,661,840.00 respectively and is contingent upon the Board of Commissioners approval of the budget for those years.
