Army Corps of Engineers for the continued operation, construction, repair and maintenance of aquatic nuisance species barriers north of the 135th Street Bridge in Will County, Illinois, and the placement of fencing and signage upon Main Channel Parcels 18.03, 19.01, 19.02 and 19.04.  Consideration shall be a nominal fee of $10.00.

Dear Sir:
 
On September 21, 2000, the Board of Commissioners ("Board") granted a 1-year easement to the United States Army Corps of Engineers ("Corps") for the construction and maintenance of an aquatic nuisance species barrier in the bed of the Main Channel north of the 135th Street Bridge in Will County, Illinois.  The Board further approved extensions of the subject easement, the last extension being granted at the Board's meeting of June 16, 2011 for a 1-year term.  The purpose of the easement is for the installation, maintenance and operation of an electrical barrier system designed to stop the migration of invasive species into the Great Lakes and tangential river systems.
 
In relation to the installation and operation of the electrical barriers, on March 19, 2009, the Board granted a permit ("Permit") authorizing the Corps to install, maintain, repair, replace and remove temporary fencing and signage upon Main Channel Parcels 18.02, 19.01, 19.02 and 19.04 to warn the public, including boaters, about the existence of dangers upon entering the waterway near the barriers.  Upon expiration of the Permit in 2011, the electronic barrier easement was amended to allow for the continued placement of the signs and fencing along the Main Channel.
 
The District's technical departments have no objections to the easement extension.  A nominal fee of $10.00 is recommended as is customary with agreements with government agencies that use District property for public purposes.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 5-year easement extension to the U. S. Army Corps of Engineers for the continued operation, construction, repair and maintenance of aquatic nuisance species barriers north of the 135th Street Bridge in Will County, Illinois, and the placement of fencing and signage upon Main Channel Parcels 18.03, 19.01, 19.02 and 19.04.  Consideration shall be a nominal fee of $10.00.
 
It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said easement extension agreement after it is approved by the General Counsel as to form and legality.
