TRANSMITTAL LETTER FOR BOARD MEETING OF NOVEMBER 5, 2026

COMMITTEE ON PROCUREMENT

Mr. John P. Murray, Executive Director

Title

Authorization to enter into an agreement for Contract 26-RFP-04, Environmental Attributes Services Provider, with Power Synch, LLC

Body

Dear Sir:

Authorization is requested to enter into an agreement for Contract 26-RFP-04, Environmental Attributes Services Provider, with Power Synch, LLC to provide environmental attribute services for the District for a three-year period, with an option to extend for up to two additional years.

Request for proposal Contract 26-RFP-04, Environmental Attributes Services Provider, was advertised on May 20, 2026. Two proposals were received on July 10, 2026 from Blue Delta Energy, LLC, and Power Synch, LLC.

A review committee consisting of representatives from the Maintenance and Operations, Law, and Procurement and Materials Management Departments evaluated the proposals. Both firms were subsequently invited for interviews, which were conducted on August 14, 2026.

Both proposers were invited to submit their Best and Final Offers (BAFOs) by September 11, 2026. Blue Delta Energy, LLC did not meet the BAFO submission requirements and was therefore deemed non-responsive.

Under the terms of the proposed agreement, Power Synch, LLC will deduct 5% from the total revenue generated from the sale of Renewable Energy Credits (RECs) produced and will charge 5% for procurement of RECs. For 2027, the District anticipates procuring RECs totaling $500,000.00 under this contract, contingent upon approval by the Board of Commissioners. Payment for REC purchases will be made via direct voucher.

Based on the evaluation process and the determination that Power Synch, LLC provides the greatest return of attribute revenue to the District, it is recommended that the Director of Procurement and Materials Management be authorized to enter into an agreement as per Section 11.4 of the Purchasing Act.

Funds for the procurement of RECs for 2027 will be from Account 101-69000-612150 and are contingent on the Board of Commissioners’ approval of the corresponding fiscal year budget.

Requested, Edward J. Staudacher, Director of Maintenance and Operations, MFM

Recommended, Darlene A. LoCascio, Director of Procurement and Materials Management

Respectfully Submitted, Precious Brady-Davis, Chairperson Committee on Procurement

Disposition of this agenda item will be documented in the official Regular Board Meeting Minutes of the Board of Commissioners for November 5, 2026
