Dear Sir:
John Guidice is an Operating Engineer II at the Stickney Water Reclamation Plant. On July 12, 2013, he sustained an injury to his left arm and right knee when he fell in a hole. Mr. Guidice was initially seen at the Industrial clinic on July 12, 2013. He was initially treated with conservative care, consisting of medicine and physical therapy. He initially was disabled effective July 13, 2013, and was able to return to light duty on October 18, 2013. He was disabled again effective December 5, 2013, after he underwent surgery. Following that procedure, he underwent a period of physical therapy. Mr. Guidice returned to light duty work on April 15, 2014. He was able to resume his regular duties effective June 14, 2014.
Mr. Guidice was paid a total of $38,935.07, which represents 32.8 weeks of lost time benefits.
Mr. Guidice’s attorney filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC). This case went to trial and the IWCC awarded the employee $54,124.50 representing 15% loss of a person as a whole. The payment of this award will not close out future medical benefits associated with this injury.
The Director of Human Resources believes that payment of this award is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
