Authority to settle the Workers’ Compensation Claim of Jesus Avina vs. MWRDGC, Claim 15 WC 25937, Illinois Workers’ Compensation Commission (IWCC), in the sum of $36,518.19, Account 901-30000-601090

Dear Sir:
Jesus Avina is a retired Maintenance Laborer A at the Stickney Water Reclamation Plant. He retired from the District on April 30, 2017. On January 29, 2013, he sustained multiple finger injuries to his left hand while loading 50 pound bags of salt. He initially sought treatment at the industrial clinic on January 30, 2013. Mr. Avina was disabled from work effective January 31, 2013. He initially treated conservatively with injections, medications, and splinting. He returned to work on May 8, 2013, but continued to experience pain in his left hand. He was disabled from work again effective June 6, 2013 and continued to receive conservative medical treatment. He returned to work again on November 16, 2013. However, the hand pain persisted and on December 24, 2013, he underwent surgeries on his left hand. He was disabled from work again at this time. He was able to return to work on January 16, 2014.
Mr. Avina was paid a total of 39.80 weeks in lost time benefits totaling $35,126.17.
Mr. Avina filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through his counsel. Subject to the approval of the IWCC, this case can now be settled for a total of $36,518.19, representing approximately 25% loss of use of the left hand. This settlement will close out future lost time and medical benefits associated with this injury.
The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
