Dear Sir:
On September 21, 2000, the District granted an easement to the United States Army Corps of Engineers (Corps) for the construction and maintenance of an aquatic nuisance species barrier in the bed of the Main Channel north of the 135th Street Bridge in Will County, Illinois. The Board of Commissioners has approved an extension of the subject easement on four different occasions. The last extension was granted at the meeting of April 5, 2007, at which time the easement was extended to May 5, 2008. The purpose of the subject easement was for the installation of an electrical barrier system designed to stop the migration of the Gobi Fish in order to protect native fish and prevent ecological damage to the Great Lakes and river system.
At its meeting of June 17, 2004, the Board of Commissioners approved the grant of an easement to the Illinois Department of Resources for the construction and maintenance of a second aquatic nuisance barrier across the Main Channel to stop the migration of the Asian Carp and other invasive species. The Corps has requested that the subject and first easement be extended for another year to allow it additional time to finalize its plans with respect to the operation and coordination of the two barriers.
The District’s technical departments have reviewed the extension request and have no objections thereto.
It is requested that the General Superintendent recommend to the Board of Commissioners that it grant a one-year extension of an easement to the United States Army Corps of Engineers for the construction and maintenance of an aquatic nuisance species barrier in the Main Channel north of the 135th Street Bridge in Will County, Illinois. Consideration shall be a nominal fee of $10.00.
It is further requested that the General Superintendent recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said easement extension agreement after it is approved by the Attorney as to form and legality.
