Authority to grant the City of Palos Heights a 47-year, 0.128± acre non-exclusive easement to construct, operate, maintain, repair and replace a 24-inch sanitary sewer on Cal-Sag Channel Parcel 8.08 in Palos Heights, Illinois. Consideration shall be a nominal fee of $10.00

Dear Sir:

 

The City of Palos Heights (“City”) leases Cal-Sag Channel (“CSC”) Parcels 8.04, 8.08 and 9.04 located in Palos Heights, Illinois for public recreational use, including the operation and maintenance of the Lake Katherine Nature Center and Botanical Gardens. The City has leased these parcels since February 4, 1988, with the current lease expiring October 31, 2073.

 

The City requests to install a sewer and to obtain a 47-year, 0.128± acre non-exclusive easement on its leasehold, specifically on CSC Parcel 8.08. The City’s proposed 24-inch sanitary sewer will connect to the City’s existing sewer line that runs along the CSC. The requested easement term is 47 years so that it coincides with the end of the lease term.

 

The District’s technical departments have reviewed the City’s easement request and have no objections thereto. A nominal fee of $10.00 is recommended as the City is a governmental entity using District property for public purposes.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant the City of Palos Heights a 47-year, 0.128± acre non-exclusive easement to construct, operate, maintain, repair and replace a 24-inch sanitary sewer on Cal-Sag Channel Parcel 8.08, in Palos Heights, Illinois. Consideration shall be a nominal fee of $10.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement after it is approved by the General Counsel as to form and legality.
