Authority to negotiate and enter into a Hazard Mitigation Grant Program Subrecipient Agreement with the Illinois Emergency Management Agency for funding for the Addison Creek Channel Improvements Project (11-187-3F)

Authorization is requested to negotiate and enter into a Hazard Mitigation Grant Program (HMGP) Subrecipient Agreement with the Illinois Emergency Management Agency (IEMA) for funding for the Addison Creek Channel Improvements Project (11-187-3F).
The Federal Emergency Management Agency’s HMGP provides funding to state, local, tribal, and territorial governments to rebuild in a way that mitigates future disaster losses in their communities. This grant funding was made available under Disaster Declaration DR-4489 related to COVID-19. The District will receive up to $10,000,000.00 in funding for the Addison Creek Channel Improvements Project (11-187-3F). On March 17, 2022, the Board authorized negotiating and entering into a memorandum of understanding (MOU) with IEMA to establish terms of usage of matching funds from the Addison Creek Channel Improvements Project for the HMGP. One of the conditions of the MOU is that projects located in Cook County will be given priority for use of HMGP funds over projects located in other counties.
The Subrecipient Agreement sets forth the standard federal requirements that are applicable to the HMGP funding, such as financial management standards, recordkeeping, performance reports, and prohibitions on the use of federal funds for political activities and lobbying. The funds awarded under the Subrecipient Agreement are expected to be obligated upon execution of the Subrecipient Agreement and must be expended within three years.
Based on the foregoing, the Engineering Department recommends that the District be authorized to negotiate and enter into a HMGP Subrecipient Agreement with the Illinois Emergency Management Agency for up to $10,000,000.00 in funding for the Addison Creek Channel Improvements Project.
It is further requested that the Chairman of the Committee on Finance, the Executive Director, and the Clerk be authorized to execute the above captioned agreement on behalf of the District, as well as any documents necessary to effectuate the agreement, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
